### 2. Eligibility & Participation (MTB Tours)
Participants must:
* Be at least 18 years old, or accompanied by a legal guardian
* Be physically capable of mountain biking on natural terrain
* Have skills appropriate for the selected tour level
* Follow all safety instructions provided by our guides
We reserve the right to refuse or terminate participation if a participant’s behavior, fitness level, or equipment presents a safety risk.

### 3. Booking, Payment & Pricing
#### Tours
* A booking becomes binding once payment is received and confirmed.
* Prices are listed in **CHF** and include applicable Swiss taxes (VAT), unless stated otherwise.
#### Custom Bike Builds
* A **non-refundable deposit** is required before ordering parts or starting work.
* The remaining balance must be paid before delivery or collection.
Estimated build times are indicative only and may change due to parts availability or supplier delays.

### 4. Cancellation & Refund Policy
#### MTB Tours – Customer Cancellations
* Cancellations made 90 Days before the tour date may be eligible for a partial refund or credit.
* Cancellations within 89 Days of the tour date are non-refundable.
#### MTB Tours – Our Cancellations
We may cancel or reschedule tours due to:
* Weather or trail conditions
* Safety concerns
* Insufficient participants
* Force majeure
In such cases, customers will receive a *a refund or rescheduling option*.
#### Custom Bike Builds
* Custom bicycles and special-order components are *non-refundable* once parts have been ordered or work has begun.
* This does not affect mandatory consumer rights under Swiss law.

### 5. Assumption of Risk & Liability (MTB Tours)
Mountain biking is an inherently risky activity that may result in injury, property damage, or death.
By participating in our tours, you acknowledge and accept that:
* You participate "at your own risk"
* You are responsible for your own actions and compliance with instructions
* Outdoor conditions and trail hazards cannot be fully controlled
To the maximum extent permitted by Swiss law:
* We exclude liability for ordinary negligence
* **Liability for gross negligence or intentional misconduct is not excluded**
Participants will be required to sign a separate liability waiver before the tour.
We strongly recommend adequate "accident and health insurance" covering mountain biking activities.

* Helmets are **mandatory** on all guided tours
* Participants are responsible for ensuring their equipment is in safe working condition
* We may inspect equipment and deny participation if it is deemed unsafe

### 7. Custom Bike Builds – Warranty & Responsibility
* Swiss statutory warranty rights apply to custom builds and components where legally required
* We are not responsible for fit, comfort, or performance issues resulting from incorrect or incomplete information provided by the customer
* Normal wear, misuse, crashes, or lack of maintenance are excluded from warranty coverage
